Please read the following terms and conditions carefully before placing any order for merchandise products from the Hong Kong Disneyland eStore (the “Merchandise Site”) on www.hongkongdisneyland.com . By using the Merchandise Site, you are accepting all these terms and conditions and will be bound by them.
1. About the Merchandise Site
1.1. The Merchandise Site is made available by Hongkong International Theme Parks Limited at Hong Kong Disneyland Resort, Lantau Island, Hong Kong (“HKITP”).
1.2. Use of the Merchandise Site and order of products through the Merchandise Site is subject to these terms and conditions and such other limits, conditions or controls (including, without limitation, limits on the number, type, value or other features of the product(s) that may be ordered by the same Guest) as HKITP may announce from time to time on the Merchandise Site, the relevant advertisement, guest communication and/or notices or signage displayed at the sales or service location.
1.3. Guests need to log in to his/her MyDisney account to use the Merchandise Site. Guest’s registered details will be retained and used in accordance with the applicable Personal Information Collection Statement and our Privacy Policies [HKITP1] set out in the relevant pages of www.hongkongdisneyland.com . Each guest is responsible for all use of the Merchandise Site via his/her MyDisney account, and it is the guest’s sole responsibility to maintain the confidentiality of his/her username and password. Guest must notify HKITP immediately in the event of any actual or suspected unauthorised use of his/her account or other breach of security. HKITP will not be liable for any use of the account by any person other than the guest.
1.4. Information relating to the products (including, without limitation, the types, retail price and available quantity) shown on the Merchandise Site are for reference only. HKITP may from time to time change the types, retail price, available quantity and other features of the products available for sale at its sole and absolute discretion by updating the Merchandise Site.
1.5. Except as expressly stated in these terms and conditions or the Merchandise Site, products, benefits, entitlements or other rights a guest may have in relation to his/her order are not for resale, and are non-transferable, non-refundable, non-exchangeable, either in whole or in part, for cash, credit or any other items, and may not be used in conjunction with other promotions, offers or discounts.
2. Placing orders
2.1. By placing an order on the Merchandise Site, the guest placing the order (“guest”) agrees to purchase the relevant product(s) from HKITP upon HKITP’s acceptance of the order. HKITP reserves the right to accept or reject any part or whole of any order in its sole and absolute discretion.
2.2. Orders may not be amended or cancelled once it is submitted in the Merchandise Site.
2.3. Guest represents that all information provided to HKITP is true, accurate and up to date in all respects. HKITP may , but is not responsible to, require further or better information to evaluate and/or process the order, or to reject any order with inaccurate or insufficient information.
2.4. Guest must be the authorised holder of the credit card used in placing orders in the Merchandise Site. Guests may not use a virtual card to place orders in the Merchandise Site.
2.5. Amount charged in connection with the order may be subject to such exchange rate, service fee and/or other administrative charge as determined and charged by HKITP and/or the payment service provider from time to time.
2.6. Neither placing orders nor purchasing product(s) through the Merchandise Site entitles the guest to any coupon, promotional offer, discount or other benefit which is not expressly offered in the relevant product description on the Merchandise Site (for example in-store discounts offered by HKITP).
3. Processing and fulfillment of orders
3.1. HKITP may accept or reject any part or whole of any order in its sole and absolute discretion . Order for a product is accepted when HKITP issues an order confirmation to the guest with the contact information provided in th e order.
3.2. HKITP will use reasonable endeavours to process an order within a reasonable time, but the processing or fulfilment time for an order is not guaranteed. Except as expressly stated to the contrary on the Merchandise Site or in an order confirmation, all references to date or time are estimates only.
3.3. HKITP may subsequently be unable to fulfill or deliver product(s) in a confirmed order, or may decide on reasonable grounds not to do so (such as if there are quality issues, safety concerns or fairness between customers where supplies are limited). Where this is the case, HKITP will inform the guest and either not take payment or, where HKITP have already done so, offer guest a refund for the product price to the original method of payment. Beyond providing guest a refund for the product price, HKITP accepts no liability for any failure to fulfill or deliver any product for any reason.
4. Redeeming a product in-store
4.1. When an ordered product is ready to be collected at a physical location, HKITP will issue a redemption notice to the guest placing the order with the contact information provided in the order.
4.2. To redeem the product, guest needs to present the QR code contained in the redemption notice (either as electronic copy on a mobile device or as printed hardcopy) in accordance with these terms and conditions and/or the terms in the redemption notice (including, without limitation, terms regarding the time, location or eligibility of redemption). HKITP may at any time change any term of redemption and will endeavor to notify guest of such change as soon as practicable.
4.3. Unless otherwise specified by HKITP, all products listed in the redemption notice must be collected at the same time. The redemption notice and the QR code will be void upon redemption of the ordered product.
4.4. Product(s) listed in a redemption notice will be released to the first person presenting the QR code. Neither HKITP nor any person is responsible for verifying the identity, eligibility or entitlement of the person presenting the QR code.
4.5. I t is the guest’s sole responsibility to maintain the confidentiality of the redemption notice and QR code of his/her order. Duplicated, used or incomplete redemption notice or QR code will not be accepted. R edemption notice and QR code are void if used, expired, altered or tampered with. HKITP shall not be responsible for (and will not issue replacement in respect of) any loss, damage, forgery, theft or fraudulent or unauthorized use of the redemption notice or QR code. HKITP’s record in relation to issue and usage of the redemption notice or QR code shall be final and conclusive.
4.6. Products may be redeemed during the operating hours of the redemption location(s). HKITP reserves the right to determine the redemption period and operating hours of the redemption location(s) in its sole and absolute discretion.
4.7. Admission to the Hong Kong Disneyland Park (“Park”) is subject to the Rules and Regulations of the Park and admission to Disney-themed hotels located adjacent to the Park (“Hotels”) are subject to the Rules and Regulations of the Hotels, as each are set out on the website at www.hongkongdisneyland.com. HKITP may from time to time, without prior notice and without refund or compensation, modify the rules, or change or adjust the entry requirements or mode of operation, including but not limited to operating hours of the Park, the Hotels or any attraction, shop, restaurant, facility or amenity, close or adjust the operation of the Park, the Hotels or any part of them for any period, restrict the number of persons having access to the Park, the Hotels or any part of them, impose purchase limit on selected merchandise items, and/or suspend or cancel any attraction, facility, amenity or entertainment or marketing program, offering or activity, and to make and alter rules to be followed within the whole or any part of the Park or the Hotels, due to capacity, inclement weather or special events, to ensure safety, security or order, or compliance with law, or if HKITP considers that the circumstances so require.
4.8. All guests are required to make reservation with valid tickets/membership cards. Park visit reservation of each type of ticket/membership card is subject to a limited quota and on a first-come-first-serve basis. Reservation will not be accepted once the respective quota is full.
4.9. As required by law, all guests (except exempted persons) must use the “LeaveHomeSafe” app and fulfill the “Vaccine Pass” requirement upon entering the Park and the designated premises in the Resort, and upon entering restaurants for dine-in. Please refer to the latest park visit arrangements at https://www.hongkongdisneyland.com/guest-services/health-and-safety/ .
4.10. HKITP reserves the right to forfeit any ordered product if the guest fails to redeem the product within the redemption period stated in the redemption notice (which is generally 21 days during the Park’s normal operation, or such shorter period stated in the Merchandise Site) in accordance with these terms and conditions, without prior notice and without any exchange, compensation or refund.
5. Receiving product by post (arrangement subject to the resort’s operation)
5.1. From time to time, delivery service may be available for certain product(s), during such periods and at such additional charge(s) as each may be specified on the Merchandise Site. Subject to service availability and these terms and conditions, guest may request to have the product delivered to an address in Hong Kong specified in the relevant order. The option for in-store redemption or delivery may not be amended once an order is submitted in the Merchandise Site.
5.2. No delivery service is available to:

HKITP may from time to time specify or change the availability or terms and conditions of delivery service generally or for specific product(s) by posting the latest information on the Merchandise Site.
5.3. If guest has requested that the product be delivered to a specified address, guest agrees that his/her personal data provided in relation to the order may be provided to, processed and used by a third party service provider (“Contractor”) for purposes relating to such order.
5.4. HKITP gives no representation or warranty as to the services provided by the Contractor. To the fullest extent permitted by applicable law, HKITP does not accept any liability for any injury, damage, loss or expense of any nature howsoever suffered or incurred as a result of the misconduct, wrongful act or omission, or negligence of the Contractor, or otherwise arising out of the services provided by the Contractor.
5.5. All applicable delivery charge(s) must be settled by guest when the order is submitted on the Merchandise Site.
5.6. Unless otherwise stated by HKITP, the delivery charge cannot be waived, reduced or refunded in any circumstances, including without limitation:
a. in combined orders for the products; or
b. in combined packaging or shipment for the products; or
c. guest cancelling the order after it is made.
5.7. Unless otherwise stated by HKITP, coupons, promotional offers, discounts or other benefits may not be used for the delivery charge.
5.8. A mobile phone message (SMS) with the estimated delivery time will be sent to the mobile number provided at the time of the order.
5.9. Guest acknowledges that the delivery time provided is only an estimate and the product may arrive earlier or later due to factors out of the control of HKITP (e.g. order quantity, distance, time of day (peak periods), weather conditions, traffic conditions, etc.). Guest should ensure that he/she or his/her authorised person is at the delivery location to receive the product.
5.10. If the guest authorises a person to receive the product at the delivery address, the authorised person shall be over 18 years of age with sufficient capacity to handle the product. The authorised person shall be deemed the authorised representative of the guest and that any instructions/information provided and act done by such authorised representative shall be deemed instructions/information provided and act done by the guest.
5.11. If the product cannot be delivered or if delivery is unreasonably delayed for any reason attributed to the guest, including but not limited to:
a. information provided by guest is incomplete or incorrect; or
b. no one was present or available to receive the product; or
c. the guest is uncontactable; or
d. lack of appropriate or sufficient access to deliver the product successfully;
e. lack of a suitable or secure location to leave the product; or
f. the authorised person is below 18 years old, or it is deemed unsafe or inappropriate for the authorised person to receive the product .
The guest alone shall bear the risk of any damage or loss or any deterioration in quality or change in condition of the product (e.g. changes in the temperature of the product). HKITP may cancel the product order without liability, compensation, refund or replacement for the product, the delivery charge or otherwise. Any request to reschedule delivery for the product will require a new order for the product and payment of the product price and delivery charge.
6. Exchange and refund
6.1. Guests are responsible for inspecting the product when the product is redeemed or delivered to the delivery address. All issues and/or defects in the product shall be reported to HKITP within 30 days from the date of redemption or delivery. In some cases, HKITP may request for photographic proof and/or additional information to properly investigate the issue with the product.
6.2. If a product is damaged, defective or wrongly delivered for reasons not attributable to the guest, the sole liability of HKITP will be either to replace the product or to provide a refund for the price paid for the product via the original payment method, in its sole and absolute discretion.
7. Orders by Magic Access Members
7.1. Except as expressly stated in these terms and conditions or the Merchandise Site, discounts or other benefits available to a guest under the Magic Access Membership Program do not apply to orders placed through the Merchandise Site.
7.2. If certain discount or benefit is expressly applicable to orders placed by Magic Access members, redemption of the ordered product and use of such discount or benefit are subject to the terms in the redemption notice, these terms and conditions, the Magic Access Terms and Conditions and other applicable terms or instructions. For example, the Magic Access member may need to present his/her valid Magic Access membership card in person upon redemption. Redemption will be refused if any of the applicable terms or instructions are not complied with.
7.3. The number and type of stamp(s) under the “Magical Rewards” promotion will be determined according to the prevailing terms, conditions or policies as of the date the ordered product are redeemed.
8. Personalization Service Guidelines

h. No text that may violate the integrity and reputation of Disney.
8.2. HKITP reserves the right to refuse personalized orders at our discretion. Inappropriate use of our personalization service will cause your order to be cancelled and any payment refunded.

9. Other terms and conditions
9.1. HKITP reserves the right to revoke any transaction with any guest and/or any order confirmation issued if HKITP reasonably believes that any of these terms and conditions are not complied with.
9.2. Proof of dispatch cannot be accepted as proof of delivery. HKITP shall not be liable for any error, omission, interruption, deletion, defect, delaying operation or transmission, communications line failure, theft, destruction, alteration of or unauthorized access to the Website, or transaction data or record lost or delayed, whether or not arising during operation of or transmission on the Website, as a result of server functions, viruses, bugs or other causes outside its control.
9.3. HKITP is not responsible for any event of force majeure, any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment, software failure or any email or registration to be received on account of technical problems or traffic congestion on the Internet, telephone lines or any website, or any combination thereof, including any injury or damage to guest’s or any other person’s computer related to or resulting from participating in, or downloading any materials relating to, this online sale.
9.4. These terms and conditions are subject to the interpretation of HKITP which shall be final and conclusive. In case of disputes, HKITP reserves the right of final decision on the dispute, and otherwise, in respect of the Merchandise Site, the product(s) and the transaction. In the event of any conflict of inconsistency between the English and Chinese versions of these terms and conditions, the English version shall prevail.
9.5. These terms and conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). The Merchandise Site and products therein are offered in accordance with the laws of Hong Kong only. Guests who choose to use the Merchandise Site and/or order the product do so on their own initiative and are responsible for compliance with local laws, if and to the extent they are applicable.
